Vehicle Ownership Change Method: What Does It Take, Where to Go?

Usually, people are more interested in buying old cars because of the price and availability of old cars. There are some legal complications involved in changing the ownership of a used car. As a result, neither the buyer nor the seller wants to go into this legal complication. But if the car is registered legally, many hassles can be avoided.

Suppose the buyer abducted a girl in your car, and when the police chased her, she left the car in fear and fled. Police seized the car. It turned out that the car was registered in your name, then you were in great danger. Suppose again that you bought the car but did not complete the registration work, then if the seller files a car theft case in your name, but you will be in danger.

To avoid these problems, vehicle ownership change and registration process must be completed.

Papers

There are three types of registration documents. For example, as a buyer, as a seller, and as an heir.

Buyer’s paperwork required

1. Form

The first piece of paper you need when buying a car is to collect the TO form (Transfer of Ownership) which you can do both in the office or online. You can download these two forms from the BRTA website. The buyer’s signature must be provided in the TO and the sample signature of the buyer must be provided in the TTO.

2. Fees

Fees come after the form. The prescribed fee for change of ownership of the vehicle has to be submitted and the original copy of the receipt has to be submitted to BRTA. If you go to the BRTA office to submit the fee, you can do a lot of work together. Once all the paperwork is sorted, the fee has to be submitted. Receipt of fee submission should be taken by submitting a copy of Blue Book to the bank official and it should be attached with other documents.

3. Submission of papers

In case of emergency papers, it is recommended to have some papers. E.g.

Buyer’s tin certificate, copy of national identity card, attested photocopy of current address phone or electricity bill, etc. No car registration is ever possible without these documents.

4. Attested documents

Fitness and route permits are one of the most important issues for a car. For this permit, photocopy of original registration, digital certificate, attested copy of new tax token, etc. have to be provided.

5. Send a letter

If the buyer buys the car for personal use then normal form and if the buyer uses the car for institutional work then the letter has to be given on the official pad. An affidavit has to be submitted in judicial form or non-judicial stamp with a photo, the value of which is BDT.200.

6. Block letter

When submitting, everything should be written in English capital letters. The buyer’s sample signature and 3 copies of color stamp size photo should be provided in the specified sample signature form.

7. Present on the spot

Everything must be shown or inspected before buying the car, so the car must be taken to the BRTA office. After submitting the fee to BRTA, one has to take a signature by showing the documents in room 100. Once you have these documents go to the inspector’s room and say you want to change the ownership of the car. An inspector will come and see your car, put a seal on it, and sign the paper.

Now you have to go to the second floor of the BRTA building and show the documents. From there he will give a single slip and will be informed when he will have to appear at the BRTA office next time. Before you go out, show this slip in room number 100 first.

8. Literacy Discrepancy

Signing is always an important issue. Those who have discrepancies in their signatures will have to come to the BRTA office in person. That’s why the seller should always be with you to change the ownership of the car. This will get rid of many unnecessary troubles. However, if the signature is inconsistent and the seller is not present, then BRTA will have to go to the AD’s room and show him the proof and the reason for the seller’s absence. And you have to write the reasons on the stamp of BDT. 200 and submit it notarized.

Documents required by the seller

1. TTO form

As a seller, the form has to be collected from the TTO and sales receipt office and signed by the seller and the revenue stamp.

2. Fees

A judicial form with photo is Rs.200 and affidavit has to be submitted in non-judicial stamp, this process will be done only if it is related to sale.

3. Certificate submission

If the seller is normal, it is a normal letter, but if it is institutional, it must provide intimation, board resolution, authorization letter on the head pad of the company.

4. Send a Letter

If the car is bought with a loan from an organization, then the loan must be repaid in advance. In this case the loan repayment certificate, loan adjustment statement and the application form along with the Assistant Director BRTA by the bank which is worth Rs. 200 or an affidavit in non-judicial stamp has to be submitted.

5. National Identity Card

The seller must have a Bangladeshi and national identity card, and show it when selling the car.

6. Signature mismatch

When giving the signature, care must be taken so that there is no discrepancy in the signature. Because the person whose signature will be inconsistent will have to come to the BRTA office in person and show the proof with the signature.

Necessary documents in case of heirs

1. Tin certificate if more than one heir

If the car is used privately or if there is more than one heir in the car ownership, then all the heirs have to submit the tin certificate.

2. Original registration certificate

In case of heirs, certificate and copy of original registration or digital registration certificate has to be submitted.

3. If there are more than one heir, everyone’s signature

If there is more than one heir in the Waris Sutra, one has to give an affidavit on a non-judicial stamp with multiple affidavits and pictures of everyone.

4. Accurate information

All the information in the sample signature form should be accurate and correct, otherwise there may be many complications in changing the ownership of the car. Here father’s name, full address and 3 copies of colored stamp size picture should be given.

After all the paperwork has been prepared and sorted properly, the responsibility of the buyer and seller will come. Buyer and seller responsibilities are very important.

Responsibility of the Seller

Within 14 days of the sale of the car, the seller must inform the registration authority of the area in which he resides and also submit a copy of the report to the recipient.

Responsibilities as a Buyer

The buyer has certain responsibilities in purchasing the car. Within 30 days of purchasing the car, the buyer will submit a report to the registration authority of the area where he resides along with the fee. And if he also receives a copy of a report from the seller, he will submit it to the registration authority so that the registration authority can record the change of ownership.

After checking all the information and documents, if the authority thinks that all the documents match, then the authority will record the matter in the registration certificate within 30 days. And if the registration authority is not the original authority, they will inform the original registration authority.

In the end, if you do not complete the legal process of car registration, you have to go through various legal complications. To avoid these legal complications, you must complete all the legal work while buying a car and stay calm.
