Offenses and penalties for driving under traffic laws

Many people use different types of motor vehicles according to their ability to save cost and time. But in order to drive a motor vehicle, everyone has to abide by certain rules and regulations. Many times due to not knowing the motor vehicle law, one has to face unwanted situations on the way. As a result, all those who drive motor vehicles should have a clear idea about the rules and penalties related to the country’s traffic laws. This will increase the awareness of the people as a driver as well as maintain discipline on the road. Let’s take a look at the punishment for any crime according to the traffic law.

1. Driving without a license

Driving without a license can result in a maximum of 4 months imprisonment or a maximum fine of Tk. 500 or both under Section 138.

2. Use of prohibited horns or noise-making devices in cars

Under Section 139, a maximum fine of Tk. 100 will be levied for the use of prohibited devices that create hydraulic horns or loud noises in vehicles.

3. Disobeying traffic laws, obstructing, and not providing information

If a driver or passenger disobeys a traffic law enforcement order or prevents someone else from complying with the order and provides information, the offender will be sentenced to a maximum of 1-month imprisonment or a maximum fine of Tk. 500 or both.

4. Driving faster than the prescribed speed

Driving faster than the prescribed speed is punishable by a maximum of 1-month imprisonment or a fine of up to Tk. 300 or both for the first offense under Section 142. If the same driver commits the crime for the second time, he will be sentenced to a maximum of 3 months imprisonment or a fine of up to Tk. 500 or both. And the license will be declared void for less than one month.

5. Driving carelessly or dangerously

According to section 143, the first offense is punishable by a maximum of six months imprisonment or a fine of Tk.500, the next offense is punishable by six months imprisonment or a fine of Tk.1000 or both. And his license will be declared void for less than one month.

6. If you drive under the influence of alcohol or drugs

For the first time, the offender will be sentenced to at least 3 months imprisonment or a fine of Tk.1000 or both. Thereafter, for each such offense, a maximum of 2 years imprisonment or a fine of up to Tk. And his license will be revoked for a specified period. This punishment belongs to section 144.

7. Physically or physically unsuitable driving

According to section 146, for the first time, a maximum fine of Tk. 500 will be imposed for this offense and the driving license will be revoked for a specified period. The same offense is punishable by 3 months imprisonment or a fine of up to Tk.500 or both.

8. Accident related crime:

Pursuant to Section 146, he shall be punished with imprisonment for a term not exceeding 3 months or with a fine not exceeding Tk.500 or with both, or if he has been previously convicted of the above offense under this section, he shall be punished with imprisonment for a term not exceeding 6 months or with fine up to Tk.1000 or both.

9. Car racing and speed test

According to section 147, he will be punished with 1-month imprisonment or a fine of Tk. 500 or both. And the driving license will be revoked for one month.

10. Driving in unsafe conditions

Imprisonment for up to 1-month or fine up to Tk. 250 or both. In case of an accident due to a similar error, in case of bodily injury or damage to property, he will be punished with imprisonment for a maximum of 3 months or a fine up to Tk.1000 or both. This penalty falls under section 149.

11. Driving a motor vehicle with black smoke

According to section 150, driving a vehicle emitting harmful black smoke will be fined a maximum of Tk. 200.

12. Car sales and modification in keeping with the motor vehicle rules

Section 151 carries a maximum penalty of two years’ imprisonment or a fine of up to Tk. 5,000, or both. It will not be used in public until done. Provided, however, that no person shall be convicted under this section if Tibi can prove that the motor vehicle shall not be used in public unless it is legally fit for use.

13. Use of motor vehicle without registration, fitness certificate, or permit

According to section 152, for the first time, the offense is punishable by imprisonment for 3 months or a fine of up to Tk. 2,000, or both. The second offense is punishable by 6 months imprisonment or a fine of up to Tk. 5,000 or both.

14. Driving heavier than the permitted weight

According to section 154, a fine of Tk.1000 for the first offense and imprisonment for up to 6 months or a fine of up to Tk.2000 or both for the same offense will be imposed the next time.

15.  The unmanned motor vehicle driving

Under section 155, he will be fined up to Tk. 2,000.

16. Driving without permission

According to section 156, imprisonment for up to 3 months, or fine up to Tk. 2000 or both. And will later be sentenced to 6 months imprisonment or a fine of up to Tk. 200 or both for the same offense.
